LIMITS ON NON ECONOMIC DAMGES IN SAN DIEGO
There are many limits on the malpractices and non economic damages in San Diego. Many laws were passed to reduce the cost of malpractices insurance of the doctors and hospitals. The laws were put together and known as the medical insurance compensation reform act (MICRA) include $120000 limitation on all non economic damages and medical malpractices case. This law has been interpreted to include a single cap on recovery of the non economic damage cause due to the medical malpractices. Although there is a limit on non economic damages which has less value on each passing year, there is no artificial limit on recovery of either loss of earnings or medical care costs.
