WHAT ARE THE ELEMENTS OF THE CASE?
Malpractices are most common in every field of work. Malpractices in medical field have become common. There are no any certain reasons for the faults and malpractices. In a malpractice law there are two parties, one is the person who claims the negligence and the other is the person against whom the case is filed. The person who files the case is called plaintiff and the opponent is called the defendant.

According to the medical malpractice law the person whoever wants to file a complaint against the defendant, needs to have a brief knowledge about the limits and laws. The plaintiff must have a clear cut view about the post operative and pre operative records. Damages – it is of prime importance in any case against the defendant, if there is no any genuine damage or serious injuries then there is basis for the claim even if the opponent (health care provider) did act as in a negligent manner.
Many problems are faced by the people due to the carelessness of the health care officer and doctors. Even the new born babies suffer from cerebral palsy and some trauma due to the wrong treatment and wrong diagnosing. Some of the people succeeded in claiming the compensation and some may not, but according to the limits and the elements of the law every person has equal right irrespective of color, caste, creed to file a case against the defendant and to get the settlements or compensation.
